One thing that Mr. Levin told me was that perhaps my prior expert Orthopaedic Surgeon did not wish to testify against Dr. Y785^5 because of the fact that they are both here in Los Angeles. Mr. Levin states that "EBO" can bring in credible expert witnesses from all over the country.

Dear List:

I recently needed to find a forensic pathologist in a matter stemming from
a formerly DP case.  One of our colleagues on this listserv, Elliott B.
Oppenheim, MD, JD, LLM, was able to find 5 suitable candidates within a
week.  The matter was complicated by Tennessee's "locality rule" - our
expert needed to be from a contiguous state and not have any ties to the
state ME's office which effectively controls all but 3 of the forensic
pathologists in this state.

Dr. Oppenheim is a good resource.

Elliott Oppenheim's assistance with the medical issues and the cross examination of the nurse not only alleviated the need to bring in our own expert, it eliminated one of my biggest concerns for the trial. By the end of cross examination, the nurse had to admit that her conclusions were pure speculation. At the top of the DA's notes for the nurse it read:

"Ugly Experience - Cross Exam"

I copied it down so that I could quote it later. ;)

Due to late discovery from the State, Elliott only received the materials from the nurse on the Friday before the Monday trial and had a list of questions by noon Sunday. Elliott went over the terms I didn't know or understand and helped me with pronunciation. His help was invaluable to the defense of this case.

Dr. Oppenheim,
Just wanted to let you know about the case. The line of questioning for the physicians was wonderful, at first they tried to say that this was a slashing by a broken bottle, but by the end turned them around to agreeing that 1) they weren’t experts in wound causation and 2) it could have been a blunt object. Dovci stood 100% by his report. At the end of the day we came back with a finding of guilt on an Assault 3, so no prison, and expugnable in 3 years.
