Auto accident

My husband was a front passenger in a car that hit an
embankment head on due to foggy conditions. He had ex-
treme back pain and was taken to a hospital by ambulace.
The attending Doctor diagnosed muscles spasms, gave him
a shot of Demeral, and placed him in a wheel chair in the
lobby of the emergency room. He was discharged within
approxiamely and hour after arrival, and X-rays were never
done. When I arrived to pick him up he was irrational,
fidgety, and sweating profusly. It took me 1 1/2 hours
to calm him down to get him in my car. On the way home
I stopped by his Chiropractors Office to beg for X-rays
which were done only to discover that he had a broken
back. L2 verebrae. For the past 2 weeks I have taken
him to the Doctors, an orthapedic specialist, and our
family doctor.
Can you tell me if the hospital that he was taken to by
ambulance right after the accident is guilty of malpractice?
